There are many causes of wrongful convictions

If you are arrested for any type of crime, you realize that your day in court will come at some point in the future.

While you hope to prove your innocence to avoid a punishment, you never know what will happen. Unfortunately, there are times when a wrongful conviction comes into play.

Here are some (but not all) of the most common causes of wrongful convictions:

  • Eyewitness misidentification. This is one of the top cause of wrongful convictions, and it's exactly what it sounds like. Witness memory is not always accurate, which is why it must be carefully preserved.
  • False confessions. There are times when an innocent person gives an incriminating statement without knowing what they are doing. It's also possible that a person could confess to a crime that he or she did not commit. This often happens during interrogation if they believe that confessing will benefit them more than maintaining their innocence.
  • Hidden agenda. For example, there are times when a person has incentive to testify against another party, especially if it will result in some type of personal or financial gain.

These are far from the only causes of wrongful conviction, but they are definitely among the most common.

With the potential for anyone to be convicted of a crime that he or she did not commit, it's imperative to understand your charges, how your case will move forward, and the defense strategy that will improve the likelihood of avoiding a conviction.

In the event of a wrongful conviction, there are steps you can take in the future to prove your innocence. This is not always easy, and it often comes after you have already received some type of punishment, such as time in jail. Even so, it's important that you do whatever it takes to protect your legal rights.

The legal system in the United States is far from perfect. It may not sound possible, but wrongful convictions are more common than many people believe. This is something that should be on your radar if your day in court is coming.
