Receiving compensation for a wrongful conviction

Two former inmates are set to receive compensation for wrongful imprisonment.

Both men filed a lawsuit in Michigan, under the recently passed Wrongful Imprisonment Compensation Act, with the hopes of receiving compensation.

One man will receive $1.76 million as a result of spending 35 years in prison for armed robbery and sexual assault that he did not commit.

The other man is set to receive more than $175,000 for three years spent in prison as the result of assault crimes that he did not commit.

Although the Wrongful Imprisonment Compensation Act was only signed into law in December 2016, it's already having an impact on the lives of two men.

How does the payment work?

Both men will receive compensation in the form of two installments. Now that they have appeared in the Michigan Court of Claims in Detroit, they will receive 20 percent of the amount within the next 30 days. After they pay their legal team they will then receive the rest of the funds.

While these men were able to receive compensation, this doesn't hold true for everyone in a similar position.

Attorneys representing the Attorney General's Office have argued in court that other people did not qualify for the same benefits. One of the attorneys said the following:

"The Wrongful Imprisonment Compensation Act does not compensate plaintiffs who show merely a reasonable doubt as to guilt; instead, the Act compensates only those whose convictions are vacated due to new evidence that clearly and convincingly demonstrates the plaintiff did not commit the crime."

Even though the Wrongful Imprisonment Compensation Act may not provide compensation to everyone who has dealt with a wrongful imprisonment, it's good that this law is now in place and in full effect.

Wrongful imprisonment is a terrible thing, as it can steal many years from a person's life. Fortunately, now in the state of Michigan, people in this position often have a course of action.
