Resale stores need to know what they can and can’t sell

There are many resale stores out there, all of which make money by selling products to end consumers. Some examples of this include consignment stores and thrift stores. Charities and individuals holding garage sales also fall under the same umbrella as more traditional resale stores.

The U.S. Consumer Product Safety Commission (CPSC) has laws and regulations that apply to anyone reselling consumer products. While the CPSC does not require these stores, charities and individuals to test each product for safety, there are some things to keep in mind:

  • They are not permitted to sell products that are known to be unsafe, such as one that has been recalled
  • Any product that does not comply with safety standards should be destroyed, as opposed to sold or given away
  • The following items are not permitted to be offered for sale: those that have been recalled by the CPSC, children's metal jewelry that doesn't meet the federal limit on lead, toys and furniture that contain a quantity of lead over the federal limit and the majority of cribs manufactured before June 2011.

As a consumer, you need to be careful about every product you buy and use. This holds true when buying new or secondhand.

If you or a family member is harmed by any type of product, regardless of where you made the purchase, you should receive immediate medical attention. From there, it is typically in your best interest to learn more about the product and your legal rights. This will help you decide what to do next, such as seeking compensation for your injuries.
