  • Malicious prosecution. This is the assertion that the officer deprived the person of his or her 14th Amendment rights to liberty. It's not always easy to win this type of claim, but it's a defense strategy to consider.
  • Excessive force. This form of police misconduct continues to make its way to the front page of the news. There is a lot of gray area here, as it can be a challenge to determine if an officer used excessive force or the amount necessary to take a person into custody.

There is no denying the fact that police officers have a difficult job. Not only do they need to patrol the streets and do whatever they can to keep people safe, but they have to follow a code of conduct at all times.

As a civilian, there could come a point when you feel that you were the victim of police misconduct. You never want to find yourself in this position, but if you do it's imperative to take notes in regard to what went wrong.
